When a person dies, someone will need to be put in charge of dealing with his or her affairs. Stillwells is able to help you apply for a grant of probate and can help you deal with the complex administration that is involved in a sensitive and cost-effective manner.

If there was a will, there will usually be one or more persons appointed to act as executors of the will who will have responsibility of administering the estate. If you have been appointed executor of the Will, you may need to apply for a grant of probate from the probate registry in order to start the process.

If there wasn’t a will (intestate), the process can be more complicated and Stillwells can advise on the steps needing to be taken in order to apply for a grant of letters of administration from the court, which will allow the estate to be administered. In most cases, the administrator will usually be a close relative – often there may be more than one person who has an equal right to do this.

When someone has died, Stillwells recommend that you notify us before the death has bee registered as we will be able to guide you through the process to ensure that all the important steps, such as requesting enough death certificates, have been taken care of to avoid unnecessary complications and expenses further down the line.

Stillwells’ experienced team of Wills and Probate solicitors are able to help you throughout the process, from applying for the initial grant of probate to establishing the value of the estate and applying for this to be released by all of the different institutions e.g. investment services that are involved.
